The Expanding Scope of Federal Kickback Compliance
with Stacy Harper, JD, MHSA, CPC, Partner, Spencer Fane LLP

Federal enforcement of relationships between physicians and referral sources has historically focused on claims to federal healthcare programs.  With the implementation of the Elimination of Kickbacks in Recovery Act (EKRA) and the recent guilty verdicts in the Forest Park Medical Center case, arrangements that carve out federal healthcare programs can no longer escape federal scrutiny.  During this presentation, we will discuss current activity under the Stark Law and Anti-Kickback Statute.  We will also identify obligations under EKRA and assess potential risks under the Travel Act based on the findings in the Forest Park case. 

    
BIO: Stacy Harper, JD, MHSA, CPC is a partner with Spencer Fane LLP focusing on regulatory compliance, healthcare reimbursement, and data privacy and cybersecurity.  Stacy aids her clients in the navigation of medical billing and coding standards, Stark, Anti-Kickback, and other state and federal reimbursement laws. She is a Certified Professional Coder with first-hand knowledge of the legal and practical reimbursement structures for government and private payors.  Stacy co-chairs the firm’s Data Privacy and Cybersecurity practice and regularly assesses risks and develops plans for organizations to coordinate data privacy, data security, and data breach response in accordance with HIPAA, HITECH, and state data laws.
